VI. SERVICE ENGAGEMENT CONDITIONS

Somia Digital's services are engaged by accepting a prior quote or proposal, which defines the scope, timelines and price of the project and forms part of these conditions. Quotes are valid for 30 calendar days unless otherwise stated, and their acceptance by any means that leaves a record authorises work to begin.

Unless expressly stated, prices do not include VAT or other applicable taxes. As a general rule an initial payment is made upon acceptance of the quote and the remaining amount on delivery; recurring services (maintenance, campaigns, hosting) are billed periodically according to the contracted plan.

The timelines given are estimates and may be affected by the availability of content, access or approvals that are the Client's responsibility, who warrants that they hold the rights to the materials they provide. Each project includes the agreed rounds of revision; changes exceeding the agreed scope may incur an additional cost, communicated and quoted in advance.

Once the total amount has been paid, the Client acquires the rights to use the final deliverables for their intended purpose. Somia Digital retains authorship of its work and may display it in its portfolio, unless a confidentiality agreement states otherwise. Both parties shall treat as confidential any non-public information they access.

If the Client cancels a project that has already started, it shall pay for the work carried out up to the cancellation date. Somia Digital's liability is limited to the correct provision of the service and, in any case, to the contracted amount, not extending to indirect damages or incidents arising from third-party services or improper use of the deliverables.

VII. LEGAL ACTIONS, APPLICABLE LEGISLATION AND JURISDICTION

Somia Digital reserves the right to bring such civil or criminal actions as it deems necessary for the improper use of the Website and Content, or for the breach of these Terms.

The relationship between the User and Somia Digital shall be governed by the regulations in force and applicable in Spanish territory. Should any dispute arise in relation to the interpretation or application of these Terms, the parties shall submit their disputes to the ordinary jurisdiction, submitting to the judges and courts that correspond according to law.
